These Terms of Use (“Terms”) govern your use of the Marigold mobile application (the “App”), operated by Chako LTD (“we,” “us,” or “our”). Please read them carefully. By downloading or using Marigold, you agree to these Terms.
1.Agreement to Terms
By accessing or using Marigold, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.
Marigold is intended for people aged 18 or older who are managing a fertility treatment journey. By using the App, you confirm that you are at least 18.
2.Not Medical Advice
Marigold is a personal organisation and tracking tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
IVF and fertility treatment are directed by your clinic and care team. Marigold helps you organise the plan they give you — it does not create, change, or validate that plan. In particular:
- Medication names, dosages, schedules, and trigger-shot timing shown in the App reflect what you enter. Always follow your clinic’s written instructions, and confirm any dose or timing with your care team.
- Reminders, countdowns, and injection-site suggestions are conveniences, not clinical instructions. Do not rely on them as your only source for taking a medication or injection.
- Charts and figures (follicle counts, hormone levels, and similar) are for your own reference and do not constitute interpretation of your results.
Never disregard professional medical advice, or delay seeking it, because of something in the App. If you think you may have a medical emergency, contact your clinic or emergency services immediately.
3.Your Responsibilities
You are responsible for the accuracy of the information you enter, including medications, dosages, appointments, results, and notes. Incorrect or incomplete entries will produce incorrect reminders and summaries.
You are also responsible for keeping your device and accounts secure. If you use iCloud sync, the protection of your data depends on your Apple ID — we recommend a strong, unique password and two-factor authentication.
4.Subscriptions and Payments
Marigold is free to download and includes core features at no charge. Some features are available through an auto-renewing subscription, offered in two plans:

Prices are shown in the App before you confirm any purchase. Prices are listed in US dollars here; the actual amount is charged in your local currency and may vary by region, and may be subject to applicable taxes.
Auto-renewal
Your subscription automatically renews for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
Billing, management, and cancellation
- Payment is charged to your Apple ID account upon confirmation of purchase.
- You can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings: Settings › your name › Subscriptions › Marigold.
- If a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a subscription that includes the same benefit.
- Deleting the App does not cancel your subscription. You must cancel through your Apple ID settings as described above.
Refunds
Purchases are processed by Apple, and refunds are handled by Apple in accordance with the Apple Media Services Terms and Conditions. We are not able to issue refunds directly. To request one, use reportaproblem.apple.com.
5.Data and Privacy
Your health data is personal, and we treat it that way. The information you track in Marigold is stored on your device and, if you enable it, in your own private iCloud account — we do not have access to your health entries. Subscription and purchase information is processed by Apple and our subscription provider so that we can deliver paid features.

6.Intellectual Property
Marigold and all of its content — including its design, code, name, logo, icons, text, and graphics — are owned by Chako LTD and are protected by intellectual-property laws. You may not copy, modify, distribute, sell, lease, or reverse-engineer any part of the App, except as permitted by law.
7.Acceptable Use
You agree not to:
- use the App for any unlawful purpose or in violation of these Terms;
- attempt to gain unauthorised access to the App, its systems, or other users’ data;
- interfere with or disrupt the App’s operation or security; or
- use the App to build a competing product or service.
8.Third-Party Services
The App relies on services provided by third parties, including Apple (for distribution, payments, and iCloud) and our subscription-management provider. Your use of those services is subject to their own terms, and we are not responsible for third-party services.
9.Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or that reminders and notifications will always be delivered on time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10.Limitation of Liability
To the fullest extent permitted by law, Chako LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of — or inability to use — the App. This includes, without limitation, missed medications or doses, delayed or undelivered reminders, or any decision made in reliance on information in the App.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud.
11.App Store Terms
Your use of Marigold is also subject to the Apple Media Services Terms and Conditions and Apple’s Standard End User License Agreement (EULA). Where those terms conflict with these Terms in respect of the App Store, Apple’s terms govern. You acknowledge that Apple has no obligation to provide support or maintenance for the App, and that Apple is a third-party beneficiary of these Terms and may enforce them.
12.Termination
You may stop using the App at any time. We may suspend or end your access to the App if you breach these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.
13.Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with them are subject to the exclusive jurisdiction of the courts of England and Wales.
14.Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the App after changes take effect means you accept the revised Terms.
